Forge Stone Bay City Concrete provides concrete contracting services including, but not limited to, driveway installation, patio construction, sidewalk building, foundation work, and related concrete services in Bay City, Michigan, and surrounding areas. The specific scope of work for each project is defined in a written estimate or contract provided to you before work begins. Services are subject to availability, site conditions, weather, and permit requirements.
All estimates provided by Forge Stone Bay City Concrete are based on information available at the time of the estimate and are subject to change if site conditions, material costs, or the scope of work change before or during the project.
An estimate is not a binding contract. A written contract or work order signed by both parties is required before work begins. Final pricing is confirmed in that document. We reserve the right to adjust pricing if unforeseen conditions are discovered during the project - such as underground obstructions, unstable soil, or existing damage not visible at the time of the estimate. We will notify you of any changes before proceeding with additional work.
Price quotes are valid for 30 days from the date of issue unless otherwise stated in writing.
Scheduling is confirmed once a signed contract and any required deposit have been received. Start dates are estimates and may be affected by weather, permit delays, or factors outside our control. We will notify you of any significant changes to the schedule as soon as possible.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellations made after materials have been ordered or work has begun may result in charges for materials, labor already performed, and reasonable restocking fees. The specific terms for cancellation charges will be stated in your written contract.
We reserve the right to reschedule or delay work due to unsafe weather conditions, permit issues, or other circumstances beyond our control. We will make every reasonable effort to complete your project on the agreed timeline.
Payment terms are specified in your written contract. A deposit may be required before work begins, with the remaining balance due upon completion of the project or at specified milestones. Accepted payment methods will be stated in your contract.
If payment is not received according to the agreed terms, we reserve the right to suspend or halt work until the outstanding balance is resolved. Late payments may be subject to interest charges as specified in the contract and permitted by Michigan law.
By agreeing to a contract with us, you acknowledge responsibility for full payment of all agreed amounts, including any authorized change orders or additional work approved in writing.
We stand behind the quality of our work. Unless otherwise stated in your written contract, we warrant that our workmanship will be free from defects caused by improper installation for a period stated in your project contract from the date of completion.
This warranty covers defects in workmanship only. It does not cover: normal settling, cracking, or wear that occurs over time; damage caused by misuse, abuse, or acts of nature including freeze-thaw cycles following the completion of the project; damage caused by work performed by others after our completion; or conditions that existed prior to our work that were outside the agreed scope.
Warranty claims must be submitted in writing to the contact information below. We will inspect the issue and respond within a reasonable time. Our liability under any warranty is limited to repair or re-performance of the defective work, at our sole discretion.
To the fullest extent permitted by applicable law, Forge Stone Bay City Concrete and its owners, employees, and subcontractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to our services shall not exceed the total amount paid by you to us for the specific project giving rise to the claim. Some jurisdictions do not allow limitations on liability, so these limits may not apply to you in their entirety.
You agree to provide safe access to the work site on the agreed start date and throughout the project. You are responsible for removing or securing personal property, vehicles, and obstacles in and around the work area before our crew arrives.
You represent that you have the legal authority to authorize work on the property and that the property is free of any legal encumbrances that would prevent the work from being performed. If underground utilities or obstructions are present, you agree to disclose any known locations to us before work begins. We will call MISS DIG 811 to have utilities marked as required by Michigan law, but we are not responsible for unmarked or privately installed lines not disclosed to us.
If you have a concern or dispute regarding our services, we encourage you to contact us first so we have an opportunity to resolve the issue directly. Most concerns can be resolved quickly through open communication.
If we are unable to resolve a dispute informally, the parties agree to attempt resolution through non-binding mediation before pursuing any other legal remedy. Any legal action arising out of or relating to these Terms or our services shall be brought in a court of competent jurisdiction in Bay County, Michigan, and both parties consent to the personal jurisdiction of those courts.
These Terms and any disputes arising out of your use of our website or our services shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.
Our website is provided for informational purposes and to allow you to contact us or request a service estimate. You agree not to use our website for any unlawful purpose, to transmit harmful or fraudulent content, or to attempt to gain unauthorized access to our systems.
